ARBITRATION OF DISPUTES 

Any dispute, claim, or controversy ("dispute") arising out of or relating to the use of this Site or the information contained in it shall be determined exclusively by arbitration in New York City.  No request for arbitration may be filed unless the claimant has given the Foundation notice of the dispute at least 30 days before initiating arbitration and has provided the Foundation with a reasonable opportunity to resolve the dispute.  Any arbitration will be conducted before a single arbitrator, unless all parties agree instead to have a panel of three arbitrators. Any arbitration will be administered by JAMS, pursuant to JAMS' Streamlined Arbitration Rules and Procedures, unless all parties agree instead to have the arbitration conducted pursuant to JAMS Comprehensive Arbitration Rules and Procedures and in accordance with the Expedited Procedures in those Rules.  Judgment on the Award may be entered in any court having jurisdiction. This clause does not preclude parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction. 

The Lotos Foundation can revise these Terms and Conditions at any time by updating this posting.
